Terms of sale

1. Subject

These Terms govern purchases on the QR Memorial website of products and services related to digital memorials (e.g. QR plaques, funeral cards with QR, editing services, memorial page hosting).

2. Who may purchase

Purchases are reserved for adults. By placing an order you confirm you are at least 18 and able to enter into a binding contract.

3. Products and services

Product/service features are described on the website pages. Images and mockups are indicative. The digital memorial is a private online space (or PIN-protected, if set) for commemorative content uploaded by the customer.

4. Prices and payments

Prices are shown in Euro and, unless otherwise stated, include VAT where applicable under current law.

Payment is made via Stripe Checkout or other methods indicated at checkout. The contract is concluded when you receive order/payment confirmation.

5. Order and confirmation

After payment you will receive email confirmation. For memorial activation and next steps we will contact you according to the timelines stated on the site (e.g. within 24 business hours, when so communicated).

6. Shipping (physical products)

Physical products are shipped to the address provided in the order. Preparation/shipping time: 5–10 business days, unless otherwise communicated. Transport risk follows the rules applicable to consumer contracts.

7. Digital memorial, PIN and content

The customer is responsible for uploaded content (photos, videos, texts, enabled comments).

Uploading unlawful, offensive, or third-party-rights-infringing content is prohibited.

If you set a PIN, you are responsible for keeping it confidential.

We may suspend or remove clearly unlawful or reported content to protect the service and third-party rights.

To report unlawful or inappropriate content, use the “Report” button on comments or follow the process on the Content reporting page.

8. Right of withdrawal (consumers)

If you are an EU/Italian consumer, you generally have 14 days to withdraw.

Important exceptions (Italian Consumer Code art. 59) include:

• custom-made / personalised goods;
• digital content not supplied on a tangible medium after you consented to immediate performance and acknowledged loss of the withdrawal right.

For personalised products (e.g. plaques/cards with specific data) and digital services already started with your consent, withdrawal may be excluded or limited as provided by law. To withdraw when applicable: email info@qrmemorial.com within the deadline, stating order number and contact details.

9. Legal guarantee

Consumers retain the legal conformity guarantee for goods under the Consumer Code.

10. Liability

QR Memorial provides the service with professional diligence. We are not liable for:

• content uploaded by the customer or third parties authorised by the customer;
• misuse of the PIN or unauthorised sharing of the link/PIN;
• interruptions due to force majeure or third-party failures (hosting, network, payments), without prejudice to mandatory consumer remedies.

Nothing in these Terms limits mandatory consumer rights.

13. Governing law and venue

These Terms are governed by Italian law.

If you are a consumer, the court of your place of residence or domicile has jurisdiction.

If you are not a consumer, the court of Bergamo has jurisdiction, subject to mandatory rules.

14. Changes

We may update these Terms by publishing a new version on the site with an update date. For orders already concluded, the version accepted at purchase applies.
